Governor Schwarzenegger just signed into law a bill that imposes an additional 90 day waiting period after filing a notice of default in order to attempt a residential loan modification.  The new law comes on top of last year’s SB 1137 that requires loan modification efforts to be made before filing the notice of default, as well as new appraisal standards and a host of federal measures from the Administration and Congress.  Can’t keep up with all these changes?

Peter S. Muñoz, a partner with Reed Smith, focuses on all forms of commercial and real estate finance transactions, asset-based loans, intellectual property financing and agricultural lending.  His clients consist of a mix of large, mid-size and small banks, savings and loan companies, equipment leasing companies, mortgage companies, and private real estate and commercial financing entities.
 
Robert K. Olsen is a principal of Aldrich & Bonnefin, PLC, specializing in consumer regulatory compliance, financial privacy, and other financial institution regulatory matters.  Prior to joining Aldrich & Bonnefin in 1996, Mr. Olsen practiced law with Stoock & Stoock & Lavan (Los Angeles), primarily in real estate transactions, and with Morrison & Foerster (Orange County and Washington, D.C.), focusing on financial institution regulation.  He also served as Senior Counsel for Settlements and Workouts with the Resolution Trust Corporation (FDIC) in Newport Beach, California.
